Hairyman Brewery’s (known here as “brewery”, “we” or “us”) website(s) (known here as “www.hairyman.com.au” or our “Site” or “Sites”), related products and services are made available to you, the purchaser of Hairyman Brewery products (known here as our “you”, “your” or “user”) in accordance with the following Terms of Use & Service and any other rules posted on our Site (known here as “TOS”). Please read the TOS carefully before placing any orders with Hairyman Brewery or on www.hairyman.com.au

We particularly wish to draw your attention to our policies relating to the terms of purchase within the TOS and our Privacy Policy, which may be modified from time to time. To use this website, you must be accepting of any changes to the TOC, however any changes made after you have placed an order, will not affect that order unless we are required to make the change by law.
REGISTRATION
You, the user, are required to register to use some of the services or features available on this Site. Registering requires you to provide information about yourself that is true, accurate, current, and complete in all respects. Should any of your registration information change, you should immediately update your information by signing into your account and editing your personal information in My Account. We may also change registration requirements from time to time. The account password you provide should be unique and kept secure, and you must notify Hairyman Brewery immediately of any breach of security or unauthorised use of your account. Please refer to our Privacy Policy for information about how we use your data.
ELIGIBILITY TO PURCHASE
You are required to provide your personal details in order to make purchases from Hairyman Brewery, directly or on this Site. You must accurately provide your real name, date of birth, phone number, e-mail address and other requested information as indicated. In addition, when you provide your payment details, you must ensure that the payment that represents and warrants you, are both valid and correct.
To use this online shopping facility, you must also verify that you are 18 years of age or over. As a NSW Liquor license holders (LIQW880014662), we are required to ascertain your eligibility to purchase based on our assessment that your age exceeds 18 years of age. We will use our discretion, where concern arise, to ascertain your age which may include contacting you direct to ensure the order is within our legal obligations. Where concerns are not resolved, we will consider not processing the order. You will be informed directly via email or phone that the order could not be processed for reasons of eligibility. At all stages of this process you are entitled to a right of reply and can relive concerns with the provision of appropriate identification (driver license or passport) that clearly identifies you and that your age exceeds 18 years.
We reserve the right to restrict multiple quantities of an item or items being shipped to any one customer or postal address.
LEGAL NOTICE
Hairyman Brewery supports the responsible service of alcohol. It is against the law to sell or supply alcohol to, or to obtain alcohol on behalf of, a person under the age of 18 years. Liquor License – LIQW880014662 Licensee – Andrew Orrell – Go Esco Pty Ltd trading as Hairyman Brewery.

ORDERS
All orders are subject to acceptance and availability, therefore the items in your shopping basket are not reserved. These may be purchased by other customers. We seek to only offer products for sale that are in stock and available for dispatch within a reasonable period of time. Occasionally however, we may be waiting for additional stock from our suppliers. Should this occur, we shall seek to notify you of the expected delivery date and you will be given the opportunity to refund your purchase if so desired. Hairyman Brewery will store a record of your transactions for a minimum of three years.
Mixed cases, will be made up of the selection you choose and priced based on your choice. To achieve best value, choosing 4 pack or 6 pack to make a 24 Pack Carton, will give the best results. Singles will cost more per item. Best value for delivery is achieved if the carton is filled to 24 cans.
ACCEPTANCE OF YOUR ORDER
You will receive an email acknowledging the details of your order once you have made your choice and your order has been placed. This email is just a confirmation we have received your order and NOT an acceptance of your order. Unless you cancel your order, acceptance of your order and completion of the contract between you and Hairyman Brewery will be completed when the goods have been dispatched. The sale contract is therefore concluded in New South Wales, Australia.
“We reserve the right not to accept your order, events such as these examples:-
we are unable to obtain authorisation for payment that shipping restrictions apply to a particular item
that the item ordered is out of stock or does not satisfy our quality control standards and is withdrawn
that you do not meet the eligibility criteria set out within the TOS
or others event deemed justifiable.
However we will not discriminate on gender, race or sexual orientation.”
PAYMENT
Prices shown on the Site are in Australian Dollars (AUD) and are inclusive of GST.
Payment can be made by eWay, Direct Bank Transfer, Visa, MasterCard, and any other methods which may be clearly advertised on the Site from time to time. We do not accept American Express cards. Payment will be debited and cleared from your account upon dispatch of your order by Hairyman Brewery. You confirm that the credit/debit card that is being used is yours or that you have been specifically authorised by the owner of the credit/debit card to use it. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to Hairyman Brewery, we will not be liable for any delay or non-delivery.
All credit/debit card transactions on this site are processed using eWay’s secure online payment gateway that encrypts your card details in a secure host environment. With the combination of SSL encryption on our website and a secure browser at your end, we take all reasonable measures to ensure that your credit card and personal information are protected when you purchase online. We also recommend that you take appropriate security precautions when accessing the Internet via public Wi-Fi networks or shared computers.
Furthermore, we take reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from the Site.
DELIVERY
For shipment and delivery, Hairyman Brewery uses Shippit, an online premier technology partner that filters the best shipping/courier options for you the user. Shippit, accesses a network of reputable courier/shipment companies that bid on your shipment. The choice of courier/shipper is yours, you can then select the best option for you and your delivery.
The cost of the delivery is added to your cart and you are required to pay the costs in full so the goods can be dispatched. NOTE should the delivery company issue additional costs incurred for the delivery (e.g. re-delivery), that are not covered in your original shipment costs, these costs will be paid by Hairyman Brewery, whereupon we will then contact you to redeem any excessive expenses. You will be require to pay these costs should we deem them to too excessive.
Once an order is complete and paid for online, Hairyman Brewery will ensure the order is ready for the pickup time. Once the order is dispatched to the courier/shipment company, it becomes their responsibility to ensure the goods arrive intact and within a reasonable timescale. You will receive an email from the delivery company which will give you a tracking number that will assist you in tracking the progress of your delivery.
In order to comply with liquor laws an adult over the age of 18 years must be present to accept the delivery and may be required to present appropriate identification. If you’re not present at the time of delivery, the courier company may elect to leave the beers at your address or you may have to pick up from your local post office or alternative parcel pick-up point as notified by the courier company. You may provide specific delivery instructions, including authorisation for the beers to be left at your address, during the checkout process.
If your order, completed at a single time, requires be more than 1 shipment, we will endeavour to ensure they the shipments are dispatched together. However we can cannot guarantee these separate shipments will arrive at the same time.
FREE SHIPPING
From time to time, we offer free shipping with over $100 of product purchased. Free Shipping is only provided to certain postcodes that we choose. These are most major postcodes in selected capital cities. We reserve the right to choose postcodes to apply our Free Shipping option to.
SAME DAY DELIVERY IS UNAVAILABLE
Hairyman Brewery does not offer same day delivery to customers. All orders are dispatched the next working day after they are received.
RETURNS, EXCHANGES, REFUNDS & CLAIMS
If in the event your purchase is faulty, damaged, wrongly described or breaches a consumer guarantee, you can return your order within 30 days and we will happily refund your money or exchange the product upon presentation of your proof of purchase. If your purchase incurred a delivery fee, then we will cover the cost of delivery for the return if Hairyman Brewery’s is at fault, within 30 days. That is, if the wrong product is delivered, there is a fault with the product (including any damage caused in transit) or Hairyman Brewery’s has breached a consumer guarantee. In all other circumstances, including change of mind, the delivery charge will be deducted from the refund to the customer. Please contact us to let us know to expect your return and return your goods to Hairyman Brewery, Unit 10, 12-14 Northumberland Road, Caringbah NSW 2229. We may not accept returns if they are received damaged or incomplete.
In the event that your product must be returned to Hairyman Brewery, please allow 2-3 business days for your refund to be processed after the product has been received by us, in sound condition. Refunds will be credited onto the credit card or into the bank account used to make the purchase.
INTELLECTUAL PROPERTY RIGHTS
Your use of the Site and its contents grants no rights to you in relation to any copyright, designs, trademarks and all other intellectual property and material rights relating to the Content (as described in the Content section below), including our Software and all HTML and other code contained in this Site. All such Content including third party trademarks, designs, and related intellectual property rights mentioned or displayed on this Site are protected by national intellectual property and other laws and international treaty provisions. You are permitted to use the Content only as expressly authorised by Hairyman Brewery. Any reproduction or redistribution of the Content is prohibited and may result in civil and criminal penalties.

In addition to the Intellectual property rights mentioned above, “Content” is defined as any graphics, photographs, including all image rights, sounds, music, video, audio or text on this Site. Hairyman Brewery tries to ensure that the information on this site is accurate and complete. Hairyman Brewery does not promise that the Content is accurate or error-free. We may make changes to the Content, materials and services at this Site, or to the products and services described in them, at any time without notice. The Content and services at this Site may be out of date, and Hairyman Brewery makes no commitment to update the materials and services at this Site. The Content, products and services of our site are provided “as is” without warranties of any kind including warranties or merchant ability, fitness for a particular purpose, or non-infringement of intellectual property. This Site is for your personal non-commercial use only.
